These terms and conditions apply to anyone who is visiting the website, associated material that is found on the website, or for those wishing to complete purchases via the Unilite website and any other matters relating to support and delivery. Definitions

Within these terms and conditions, ‘Our’, ‘We’ and ‘Us’ refers to Unilite Limited. You and Your refers to the person reading the terms and the users of the website. If you wish for clarity on any part of our terms & conditions, please email support@unilite.com.au

Our web services

Our products and services are intended for adults over the age of 18. By proceeding to browse and purchase goods through the website’s eCommerce platform, you confirm that you are over the age of 18.

All prices shown are in Australian Dollars (AUD) and include GST. If an order has been placed through the website’s eCommerce platform at a stated price, then we will endeavor to hold that price. We reserve the right to change our prices without prior notice, either by increasing or decreasing their values.

From time to time we may change our terms and conditions. At the time you make a purchase the current terms and conditions are binding. Products

We endeavour to ensure the products listed on our website, promotional material, brochures and any other material released by Unilite, both online and in print form, matches the true descriptions of the products and associated parts. We are however not bound to these details as specifications are likely to change in a products life-cycle or during manufacture. If we spot any errors, then we reserve the right to amend and correct any error or omission.

We also reserve the right to change product specification, design of both the product and its packaging and any other related information or material without notice.

The images provided throughout the website and any additional material are for illustrative purposes only and we do not guarantee any image will be a true reflection of colour and the full design of the product. We use 3D Renders to produce some of our product designs and as a result these may differ from the actual product they are portraying.

We endeavour to update our online inventory in line with our actual stock inventory. This is monitored on a regular basis and when stock is low, we will list this on our eCommerce platform. From time to time there may be a discrepancy in this relationship whereby a product may be listed as available, when in fact it is no longer available. If this does occur and the product is no longer available, we will contact you and allow you to either wait for the item to become available, swap for another similar line, or provide a refund for the value of the goods and delivery charges.

Upon placing your order with us, you will receive an email confirming your purchase. You will then receive a second email confirming the order has been accepted and the goods have been dispatched.

For any orders that contain a product that is not yet in stock, we will place this whole order on a back order. We will then dispatch the whole goods out when all the items are in stock.

On occasions we may reject your order. Acceptance or rejection of an order takes place within one working day, with the most common reason being the item is out of stock. In this instance we are not required to give any reason why the order has been rejected. If we have not sent you a second email confirming your order, then you can consider your order has been rejected.

Orders that contain a mystery gift or promotional extras, are subject to a minimum spending requirement. We reserve the right to decide the value of extra promotional material.

Authorised discount codes may be used on this website. Discount codes may not be used in conjunction with any products that are already on sale.

When you order from us, we require your name, delivery address, email address, telephone number and credit/debit card details or other payment method. We undertake great levels of care with this information, however by providing us with this information you accept that we are not liable for any misuse of this data due to error in transmission or virus or malware.

The delivery terms of your goods will be stated on our website. The title and ownership of the goods passes to you when we have received payment in full. Our terms are set out on the order page for you to review.

All risk of damage or loss to the goods passes over to you when the goods are dispatched.

Access to our Website

When you visit our website, we give you limited license to access and use the information for personal use.

You are permitted to download copies of the information on this website, or any other linked Unilite documentation or material for personal use only. Any attempts to change copyrighted symbols, trademarks or any other misuse of content from this website is an infringement of our intellectual property rights. Individuals who do so are at risk of breaking copyright laws and may face prosecution.

Except as permitted under the Copyright, Designs and Patents Act 1988, you are not permitted to copy, reproduce, republish, distribute or display any of the information on this website without our prior written permission.

Under the license to access this website, any use of data mining robots, or other extraction tools on this website is not permitted. The license does not include the permit for you to metatag or mirror our website in any way without prior written permission. We reserve the right to serve you with legal notice if we become aware of any metatag or mirroring of our website.

We will grant you access to our website on a temporary basis. We cannot always guarantee access to our website will be available or uninterrupted. We reserve the right without notice to suspend, withdraw, discontinue or change all or any part of our website. We will not be liable in any way if our site is unavailable at any time or for a period of time. It is your responsibility to provide access to our website. We regularly update information on our site, which may include specifications and content. Therefore, at any time our site may be out of date and where this is the case, we are under obligations to update it. Unilite are the owners of all intellectual property rights on our website and any material published on it, unless otherwise stated. You must not modify any digital or paper copies of our materials that you have printed or downloaded as this will be an infringement in our intellectual property. Where images exist alongside text, you must not separate and/or remove either the images from the accompanying text, or the text from the accompanying images. You must also not use photographs, videos or audio sequences separately from their accompanying media.

Any modification of content on our website will need a license from Unilite in order to do so.

Intellectual Property Rights

The copyright to all content on this website including product images, graphics, logos, symbols, media and text belongs to us, or we have been provided permission to use these materials.

Any trademarks, brands and logos with the symbols TM © or ® which are used on this website are owned by us, or are provided to us under license. Your access to our website does not allow you to use these in any commercial way without written permission.

Product Certification

Unilite has the responsibility for declaring product conformity with all the legal requirements. Our products have been certified and tested according to the appropriate standards with the relevant notified bodies. As there is a legal presumption of conformity, Unilite Limited’s responsibility to prove conformity does not extend to providing all the information and supporting documentation in a product technical file concerning the CE or UKCA marking unless it is requested by a market surveillance authority.

Hyperlinks

You may link our website without our consent. This is done completely at your expense and you must accept responsibility for this. By linking our website, you must not alter, or change any of our websites content, including anything covered under intellectual property notice. You must also not re-frame, reformat or alter any of our webpages, files, images, text or any other material found on, or via the website.

Disclaimers

We take all due care to ensure our website is free from viruses, Trojan horse and malware. We are however not responsible for any damage to your computer system, or any other device which would arise in connection with using our website, or any linked website or media.

Delivery

For deliveries of both Unilite products and materials, we use a third-party courier service. We can provide the customer with tracking information so that they are able to track their parcel and ensure they are available for delivery on that day. It is not the responsibility of us to track the parcel and provide information relating to when the parcel is set to arrive with the customer.

We will endeavour to provide the purchased goods by the time and delivery dates specified. If the goods do not arrive within this time frame, we will not be held responsible for any loss incurred financially, through loss or income, or otherwise.

Payment Terms

To use our eCommerce platform, you must agree to pay via: World Pay, Apple Pay, Google Pay or PayPal. All transactions are in Australian Dollars (AUD).

Order Cancellations

When a product has been listed with incorrect descriptive information, incorrect prices, or with the wrong image or similar mistake, we reserve the right to cancel your order. If you have been charged, we will refund the same payment method for the total amount debited.

You may be able to cancel your order after it has been placed, so that it does not get dispatched. If you wish to do so, please contact us immediately by emailing support@unilite.com.au

Any granted cancellations will be at our discretion and will be based on whether the order has been processed and in the hands with our courier.

If you need to change an address on an order, you have 30 minutes to inform us of the new address.

If you want to return any goods you have purchased, you have to notify us of your intention to do so within 14 days. As soon as you have notified us of your intention you then have a further 14 days to return the goods (our returns address is below). Please note: It is your responsibility to make sure the items are securely packaged, labelled and transported in accordance with all applicable laws and regulations (including those relating to the transport of hazardous materials).

If there is no fault with the item and you simply change your mind then you must return the item in a re-saleable condition, including all parts and accessories and with no damage to the product or packaging. You will be responsible for paying for return postage on all returns. We will refund the cost of the items.

This is our returns procedure for cancelled orders:

  1. Email us at support@unilite.com.au and state your order number from your invoice and what you will be sending back. We need this and cannot process a refund without this.
  2. In order to process your refund, you must send the goods back in the same condition that it was sent out in. We recommend you use sufficient quantities of suitable packaging to ensure the goods are protected in transit. We also highly recommend using a ‘signed for’ mailing service to make sure it arrives with us and limits the chance of it being lost. We cannot refund damaged or lost stock.
  3. We understand that product packaging may be opened to inspect products, however we still need to resell the items. We cannot refund on seriously damage packaging. Please also ensure that you do not write on packaging or use excessive amounts of tape as this may cause damage. We recommend wrapping the product packaging in protective materials such as bubble wrap or quality brown paper to help keep it from becoming damaged, then package inside a cardboard box or strong jiffy envelope.
  4. You will be responsible for paying for your own shipping when returning.
  5. Once your item has been received, we will notify you that we have received the goods. We will conduct a brief inspection on the goods, we will then send an email informing you whether a refund will be granted or not. On the rare occasion we cannot grant a refund, we will let you know as quickly as possible. We have 30 days to refund your money in full, although this will normally be a lot sooner.
  6. For us to be able to process your return, it is important that you enclose a note with your contact details and order number so we can trace your order and get in touch with you. Without this we will not be able to process your return.

Faulty Goods

In the unlikely event a product has developed a fault within the first 30 days from the date of delivery, please contact us on the above details. This is because some products that appear to have a fault, may just have a feature that is not fully understood, but may be mistaken for a fault.

If we think the goods may be faulty, you will be asked to send the product back to us. We will inspect the goods and assess if a fault is recognised. If one has been found, in the first instance we will offer you a like for like replacement or repair. If this is not prefered we will offer a refund.

We aim to process all returns within a 7 days of arrival of the goods back to us. We always endeavour to turn around within as few days as possible, however at peak times please allow a slight delay in processing your return.

For all goods over 30 days old and still under warranty, we will offer a repair or replacement of the goods.

For any repaired or replaced products, we will pay for the shipping back out to you. You must however pay to send the goods back to us.

If we find that a fault is not due to a manufacturing fault then the item will be offered back to you at your cost and no refund or replacement will be made.

This does not affect your statutory rights as stated by the Consumer Rights Act 2015.

Damaged Goods

If a box arrives damaged, please take a photo as proof and do not throw the box away. You can then contact us at support@unilite.com.au and we will speak to the carrier service and make a claim.  Please do not delay, as many carrier services have a short window to make a claim. You have 48 hours from receiving an order to inform us of any damage that has occurred. You are of course free to inspect the goods inside the packaging and use them if you wish to keep them

In the unlikely event that your goods are damaged, please contact us immediately on the above contact details and we will make a claim with the carrier. Again, please take as many photos as you can as this will help with the claim process.

Under no circumstances should you return your damaged goods before emailing us, as this is likely to invalidate any claim we can make against the carriers who caused the damage.

This does not affect your statutory rights.

Warranty

We endeavour to ensure the goods sold on this website are free from defects in their workmanship, materials and parts used. We provide a guarantee of at least 1 year for all electronic products and work bags. All other items are guaranteed for a period of 6 months. This warranty only covers products purchased on this website and through this eCommerce platform. We also offer an optional extended warranty that covers electronic products and work bags for an additional 12 months free of charge by filling out the extended warranty form on the website.

If any Unilite products are purchased via another vendor, either online, or otherwise, we will not be responsible for creating an action against the faulty product, the customer should instead contact the vendor where the goods were purchased from.

The warranty we offer is against a genuine fault or defect that has occurred through reasonable usage of the goods. We will not however be liable for any defects resulting from normal wear and tear, wilful damage, accident, improper use of the goods as to which they were intended, using the goods in environments to which they are not suited, battery leaks or any other incorrect use of the products.

Any adjustments, modifications, or self-repair of the goods will void the warranty and we will not be held responsible for any injury, or loss caused by these or other action whereby the goods are used improperly. This also includes use of non Unilite supplied chargers.

It is the full responsibility of the customer to choose the correct product to fit the needs and environment that the product will be used in. If a product has been chosen for an environment or need that it is not suitable for, then we will not be held responsible for any injury, or loss caused by using this product.

If the goods become damaged or defective as a result of being used in the wrong environment, or in the way to which the goods were not intended, then this will not be covered under warranty.

In the result of genuinely faulty goods that have malfunctioned as a result of normal usage, we will offer either a repair or replacement for the term of the warranty as specified. If the customer wishes to request a refund on their faulty goods, they can do so within the first 30 days from when the goods arrive at the customers chosen delivery destination. We will obtain proof of delivery via a courier and will assume the goods have arrived with the customer, or at their premises unless otherwise notified by the customer. These terms do not infringe a customer’s statutory rights and we fully oblige to all terms under The Consumer Rights Act 2015.

Limitation of Liability

To the fullest extend permittable by law, our liability for any breach of an implied warranty or condition is limited to the supply of the goods and/or services, or payment for the costs of having those goods and/or services supplied again.

We do not accept liability for any loss, including that with consequence, for loss suffered by you arising from products and/or services we have supplied.

We will not be liable for: Loss or damage of any kind to premises or other tangible property of the customer as a result of using our goods. We will also not be responsible for any economic loss, loss of profit or indirect loss or damage to the customer, and without limitation, any damage to the customers business if used for such means, as a result of being supplied, or in connection with being supplied the goods, including any delay in supply.

We accept no liability for any loss whether in contract, tort (including negligence), breach of statutory duty or otherwise arising under or in connection with use of or inability to use our site or use or reliance of any content displayed on our site and we will not be liable for any loss of profits, sale, business or revenue, business interruption, loss of savings, loss of business opportunity, goodwill, reputation or any indirect or consequential loss or damage. Further, we assume no responsibility for the content of websites linked to our website (if any), and such links should not be interpreted as an endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

If at any point you are invited, or allowed to upload content to our site, then any content you upload to our site will be considered non-confidential and non-proprietary and we will have the right to use, copy, distribute and disclose to any third party who is claiming that the content posted or uploaded by you constitutes a violation of their Intellectual Property Rights or their right to privacy. We will not be responsible or liable to any third party for the content or accuracy of any content posted by you or any other user of our site. We have the right to remove any posting you make on our site if we determine that this is not an acceptable use of our site. Further, we will pursue you for all losses incurred if any content that you upload or display on our site is in our opinion undesirable, defamatory, illegal or unacceptable and reserve the right to remove the same forthwith.

You must not attempt, or work in collaboration with others to gain unauthorised access to our site or in any way attack our site and breaching this provision would commit a criminal offence under the Computer Misuse Act 1990 and we will report such a breach to the relevant Law Enforcement Authorities.

We cannot guarantee that our site will be free of bugs, viruses and other harmful associated infections and you should therefore use your own virus protection software.

We do not seek to exclude or restrict any legal liability we may have as a result of death or personal injury as a result of our negligence or restrict any of our legal obligations arising under the Consumer Rights Act 2015.

Indemnity

By accessing our website, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our website.

Jurisdiction

These terms and conditions are to be governed by and construed in accordance with the laws of England and any claim made by either party against the other which in any way arises out of these terms and conditions will be heard in England and you agree to submit to the jurisdiction of those Courts.

If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity. If necessary, the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.

We handle any and all information you provide to us through our website, or any associated web form, with the greatest level of care. We cannot ensure and do not warrant the security of any information you provide to us. Any information you transmit and provide to us is entirely at your own risk, although we endeavour to undertake reasonable steps to preserve such information in a secure manner.
